PRIVACY NOTIFICATION AND WAIVER

LEGAL AUTHORITY AND REASON FOR COLLECTION OF PERSONAL INFORMATION

The Voters FIRST Act (Act) and the regulations implementing the Act require that the selection of commissioners for the Citizens Redistricting Commission (Commission) be open to public scrutiny and the press (California Constitution, Article XXI, section 2, subdivision (c); Government Code sections 8252, 11120, 11121, and 11125.1; California Code of Regulations, title 2, sections 60835, 60836, 60842, and 60846). The Act also requires the California State Auditor's Office (State Auditor's Office) to select 60 of the most qualified applicants based upon their voter affiliation; eligibility to serve pursuant to Article XXI of the California Constitution; the absence of any conflicts of interest; relevant analytical skills; ability to be impartial; appreciation for California's diverse demographics and geography; and racial, ethnic, geographic, gender, and economic diversity. To determine each applicant's identity and qualifications to serve on the Commission and to track the demographic information of the applicant pool, this application seeks personal information about applicants that will be provided to the Applicant Review Panel, State Auditor's Office staff, and the public, including members of the press, the Legislature, and the Commission.

CONSEQUENCE OF NOT PROVIDING ALL REQUESTED INFORMATION

Failure to provide all of the requested information will result in your disqualification and the removal of your name from the applicant pool. Thus, if you wish to serve on the Commission, it is mandatory that you submit a response for each item of information requested.

Part 1: Essay Questions:

The response to each of the following essay questions is limited to no more than 3200 characters including spaces (approximately 500 words). The response fields below will allow you to cut and paste text from any word processing program such as Microsoft Word.

In my opinion, the importance of the Citizens Redistricting Commission is to draw district boundaries that are representative of their communities' areas of interest, not a political party. In November 2008, voters approved the creation of this new impartial commission to take the responsibility of the redistricting process away from the elected Legislators. I believe the hope was to have the district boundaries be reflective of the communities, not the incumbent Legislators who drew the boundaries for their own self-interests and self-preservation. It is important that the district boundaries be drawn to appropriately reflect the demographics of that area without influence from political pressures.

People need to be reenergized in their faith in the legislative system. We need to have them come out to vote, exercise their right, and see it as a way to voice their opinions to help pave the future. Our residents saw the Legislature as disconnected. If the Legislature is reflective of the pulse of its residents, there should be a renewed interest in participating in the electoral system by voting. This needs to be a partnership not an adversarial environment.

I want to be part of this impartial process, to hopefully reenergize Californians into believing their voice has an impact on decisions and to help shape the future of California. I enjoy going to new places, listening to what's important to everyone because it is all relevant, and everyone and every community have different priorities, wants, and dreams that should not be ignored or dismissed.
I believe I have the temperament, background, knowledge, and experience to be an asset to not only the commission but to the people of California by representing them on the Citizens Redistricting Commission. I have the dedication to follow this through by being available as needed and listening to the people. This would be another step in my giving back to the people of this state, and doing my best to ensure the district boundaries are drawn to be reflective of their personality.

I would appreciate being part of an effort to shorten the gap between the politicians and its residents. I believe we can make headway in building confidence in our legislative process by being transparent in our efforts and obtaining feedback from as many communities as possible. I do that now as the School Board President of the River Delta Unified School District. I welcome feedback from the community and concerned constituents. I want to do the best we can to have the residents feel involved and heard which will hopefully lead to healthier communication between them and the elected officials. The school district has recently redrawn the district trustee boundary areas, ensuring the communities were represented with similar interests and demographics. Although this effort was at a much smaller scale than statewide redistricting, it was representative of remapping boundary areas to reflect the areas' population and communities.

To be impartial is to have the ability to set aside your own personal views and opinions in order to evaluate the information provided to ensure decisions made are fair to all affected. We all have biases that change throughout our lives based on our family, community, education, experiences, culture, and personal interests. The challenge is to recognize those biases and learn to use them to strengthen and broaden you as a person in order to respect the differences.

I truly do not believe I have any personal, family, financial relationships, commitments, or aspirations that would improperly influence me from making a redistricting decision. I do voice my opinion and back my opinions with data when applicable, but I am also open to others' points of view. We have to listen and be open minded to see what is important to them, and appreciate the similarities and respect the differences.

I do have strong opinions but I am also able to listen and take in different points of view. I have the capacity to set aside my points of view to appreciate others' opinions. I attempt to make decisions that are fair to everyone affected. We don't know everything, and willing to be open to opposing viewpoints makes us a stronger united front.

As a school board trustee for the last thirteen years, I have continually set aside my personal opinions and goals to ensure the decisions made are in the best interest of all students in the district, not just those in my trustee area. For example, a few years ago we went through budget cuts throughout the district. I set aside my own wants to ensure the cuts were equal throughout the district school sites so that no school or area was more heavily impacted. Many times I have supported and voted for decisions that did not necessarily benefit my trustee area but were the best solutions for all students in the district.

When I ran against the incumbent for school board, we ran a grass roots campaign. That was probably one of the most educational experiences I had as we walked every neighborhood and I was able to understand their priorities and issues. I ran a "Kids first" campaign and continued to go back to that mantra to ensure I was doing the right thing for the whole, not for the part.

Also, as a Special Agent my recommendations as to whether to open investigations rely solely on the information and documentation received, regardless of previous knowledge of the subject or subject matter. Further, while conducting my investigations I consistently presented information that was free of opinions so as to ensure an unbiased, impartial report.

I am very passionate in my beliefs so I have an appreciation for others who are just as passionate about their beliefs. It's been a very moving experience to come to this realization as I have actually changed my position a few times, and even when I didn't change my position, I respected their differing viewpoints and understood we had more in common than I had anticipated.

California is truly the melting pot of the world. We have many different demographic characteristics that possibly encompasses all races and ethnicities. We have the opportunity to collaborate and build on our differences because in the end, most of us have similar goals, wants, and needs. Once we stop focusing on our differences, we can see the commonalities and build a better, stronger California for future generations. We need to make people feel included instead of excluded in the political process.

The challenge is being able to change people's opinions, or at a minimum having them listen and educating them on differing viewpoints. I believe I have the ability to welcomed others' opinions, culture, and beliefs because I know how difficult it is to feel as if you belong. In the end we share much in common and those things that aren't common, are not necessarily wrong, but just different. We are all unique as are our beliefs and values. If I expect to be accepted and respected, then I in turn need to accept and respect others, regardless of how different we are.

I have had the opportunity to volunteer in different venues, mainly in the education arena and in socioeconomically challenged areas. For many years, I have volunteered at elementary schools with a large percentage of English-learner students. It has been very rewarding to see a kindergartener speaking and reading English by the end of the school year. In the end, we can learn much from children, from their unbiases, their quest for learning, and their easy acceptance of others.

Being a School Board Trustee has been educational as I have learned the issues and priorities of each represented area. I had assumed since we were all farming communities, we all had the same priorities and goals. How mistaken I was. This is the same for the rest of California, even neighboring communities have different wants and needs. Diversity means differences, not bad or good but just differences.

We need representation to match the demographics of Californians. For example, the school district I represent was over 50% Hispanic yet they had never been represented during my decades in the area. In my opinion their needs weren't being addressed as the board members didn't understand their struggles which in turn led to decisions being made without being appropriately educated about all of their students' needs. As such, I ran against the incumbent and won. It was truly a grass roots effort as we canvassed each community. This was a rewarding process as I gained a better understanding and appreciation for each community. Instead of thinking I would be educating them, they educated me in understanding we all wanted the best for our students and children. Also, by my being able to educate my fellow board members on the struggles and challenges of the migrant and low-income population, in my opinion, we made better decisions by understanding the needs of our diverse district.

As I learned, even in a small area there is diversity, and on a bigger level, the diversity is compounded. The importance is understanding the differences and making decisions based on that knowledge.

Since I can remember I have always loved and excelled in mathematics, marveling in how number manipulation can greatly change the position of a financial scenario. With that, I received my undergraduate and graduate degrees in business management, with a concentration in finance which entailed many mathematical-related classes such as pre-calculus, statistics, business math, and managerial finance.

The first opportunity to utilize the analytical skills I learned in college was during my first full-time job as an auditor where I researched education code, developed audit programs, researched financial data, and then audited the local educational agencies in said education code. I reviewed their financial records and internal control processes, and made recommendations on how to improve their procedures.

Probably one of my favorite jobs was as a budget analyst for the Department of Corrections. I was responsible for analyzing the budgets for my assigned institutions. I reviewed their expenditure detail, accounting records, prior years' expenditures, current year projections, and the expenditure activity of other institutions. I made recommendations for budget revisions which I always backed with supporting documentation.

As an education fiscal services consultant, I analyzed the fiscal condition of several local educational agencies, proposed district reorganizations, and charter school budgets. This entailed reviewing detailed financial reports, preparing multi-year projections, and making recommendations on the fiscal viability of the proposals.

As a school board trustee, annually I review and approve the district's financial reports to include the first and second interim reports, proposed budget, and year-end reports. I review the detailed information presented and question areas of concern. I compare current year to prior year expenditures to determine appropriateness of the information presented. Also, when we recently redrew the school board trustee areas, I reviewed the proposed mapping options and requested revised maps that would represent communities better. I read the applicable education code to ensure we were mapping the boundaries in accordance with the law. This process was conducted in a public forum.

As a Deputy Inspector General I conducted fraud investigations (workers compensation, doctors' billing practices, substance abuse program) which involved reviewing various detailed reports to include expenditure information, documentation to support the expenditures reported, and video camera footage to confirm the documentation provided.

As a special agent every case required me to review detailed documents, often times acquiring subject matter experts to differentiate facts from opinions. The documents encompassed policies, financial data, and other supporting evidence. I also had to determine the best way to present the information which was always in writing and many times I included spreadsheets to present the information in a format that was easier to understand.

Activities

Since December 2006, I have been an elected School Board Trustee of the River Delta Unified School District. I have been President for at least six of those years, Vice President for two years, and Secretary for two years. Unless specifically related to closed session material, our meetings are conducted in open session. We always have a public comment portion where attendees can address areas of concern that are not covered in the agenda. Also, during action items we allow public input and appreciate the community residents being involved and providing their feedback. Although I always try to obtain as much information as possible prior to making decisions, having community involvement is valuable and important as it allows us to see the human impact of decisions being contemplated.

As noted in the responses to the prior supplemental questions, the recent redistricting of the school district trustee boundary areas was based on the census information. I reviewed the education code language to ensure we were in compliance with the specific code sections, and I requested different options to ensure the communities would be appropriately represented.

I was a board member for a Christian youth basketball league for over six years. Because I did not have any children participating in the league, I ensured impartiality when others wanted to make decisions that only affected their child instead of considering the impact to the entire league.

I have coached youth basketball, soccer, and high school volleyball. I have been on the school site council for my local elementary school. I am active at St. Joseph Catholic Church, having taught Catholic Faith Formation for four years, taking communion to the sick, and helping as requested. I have volunteered at elementary schools and helped the community with fundraising activities for the youth. This has been rewarding as I have been able to meet families that have different background and needs.

I have experience working with elected officials (School Board, CalPERS Board), a volunteer board (youth basketball), and various community efforts. I have worked collaboratively within the groups to ensure we remain focused. A win is when we find common ground, where we can all take away a positive.

One of my greatest challenge was helping lead the effort to open a charter school when the school board voted to close down our local elementary school. As an Education Fiscal Services Consultant, I was familiar with charter school laws and funding. We had strong community support and members that were well connected with the Legislature. We divided the responsibilities based on each individual's strengths. My area of expertise was on the fiscal side, developing a working budget and applying and obtaining a $450,000 startup grant. As one can imagine, this took dedication from all involved and it was truly a grass roots effort as everyone stepped in to help where they could. We came from different backgrounds but had a common goal and were all focused on one mission. The charter was approved and we eventually opened a charter school in our community which is now flourishing with a waiting list.

Although it is not necessary that I know every detail of every problem, the key is knowing how and when to question why a particular approach was chosen and whether there are other alternatives. As a number's person, I have reviewed volumes of data on budgets, investigations, and other issues. I frequently validate the information provided by reviewing the source documents and seeking out subject matter experts in order to separate opinions from facts. I conduct research as appropriate and reach out to external sources. Further, I welcome feedback from others, specifically those impacted by the decisions contemplated. However, I always ensure we remained focused of the task on hand.

It is important that the district boundaries be drawn to appropriately reflect the demographics of the areas without influence from political pressures. Being bi-lingual and bi-cultural, I believe it is important to value the melting pot of Californians.

When I was first elected to the school board, I asked many questions and educated myself on the actions being contemplated. As such, I was often the solo no vote if I wasn't convinced the decision would be in the best interests of the entire district. Little by little, I began educating the other board members on different points of views and they in turn educated me. We eventually started working as a team, voting for the best solutions for all students, not just our respective trustee areas. This will be similar with us redrawing the district boundaries, not everyone will be happy, but we should get to a point where we feel we made the best decisions based on all the information we gathered to include the census information, applicable maps, and community input. Hopefully, residents feel they were heard and understand we did the best we could based on all competing factors.

I understand and have interpreted California law specifically related to the Education Code, Penal Code, and Government Code. I have drafted legislation, completed legislative bill analysis, and determined the impact of the proposed legislation on the program areas.

I am proficient in various software programs to include Microsoft Excel, Word, PowerPoint, and Office.

Basically, every job I have had once I obtained my college degrees, has been analytical and required translating my findings into written format and many times verbally presenting my findings. As such, I ensured my work was thoroughly researched and analyzed. As needed, I consulted with subject matter experts and contacted external agencies to obtain needed information. I never hesitated to ask for help when needed and worked in teams as appropriate.

I believe all the information I have provided in this supplemental application are valuable skills needed to effectively be part of this effort. I appreciate being considered to be a Commissioner and welcome the opportunity to serve on the Citizens Redistricting Commission.

Part 4: Letters of Recommendation

An applicant must submit, or arrange for the submission of, three letters of recommendation from individuals or organizations. A letter of recommendation may be no longer than three pages. An applicant's letters of recommendation must be submitted to the California State Auditor's Office (State Auditor's Office) on or before October 20, 2019. All three letters of recommendation must include your applicant identification number, which is 12652. This identification number is unique to your application and ensures that all of your letters of recommendation are correctly attached to your application file before they are reviewed by the Applicant Review Panel.

Part 6: PRIVACY NOTIFICATION AND WAIVER

LEGAL AUTHORITY AND REASON FOR COLLECTION OF PERSONAL INFORMATION

The Voters FIRST Act (Act) and the regulations implementing the Act require that the selection of commissioners for the Citizens Redistricting Commission (Commission) be open to public scrutiny and the press (California Constitution, Article XXI, section 2, subdivision (c); Government Code sections 8252, 11120, 11121, and 11125.1; California Code of Regulations, title 2, sections 60835, 60836, 60842, and 60846). The Act also requires the California State Auditor's Office (State Auditor's Office) to select 60 of the most qualified applicants based upon their voter affiliation; eligibility to serve pursuant to Article XXI of the California Constitution; the absence of any conflicts of interest; relevant analytical skills; ability to be impartial; appreciation for California's diverse demographics and geography; and racial, ethnic, geographic, gender, and economic diversity. To determine each applicant's identity and qualifications to serve on the Commission and to track the demographic information of the applicant pool, this application seeks personal information about applicants that will be provided to the Applicant Review Panel, State Auditor's Office staff, and the public, including members of the press, the Legislature, and the Commission.

My name is Kirk Stinson. I am the Chief of Field Operations for the California Department of Corrections and Rehabilitation's (CDCR) Office of Internal Affairs (OIA). My position requires me to be responsible for upholding the integrity of Departmental policies and the disciplinary process. It is an important position, whereby almost 70,000 employees, contractors and volunteers rely upon our detailed analysis and impartial investigations to ensure their rights of due process are protected.

In my capacity as Chief, I manage three Regional Field Offices whose mission is to conduct internal affairs investigations statewide. I manage over 100 staff in the Special Agent classification responsible for investigating complex criminal and administrative investigations. Many OIA staff are assigned to task forces and participate in multi-jurisdictional investigations, including the Federal Bureau of Investigation and Office of the United States Marshal's Service.

I first met Alicia when she came to work at the Office of Internal Affairs in 2013. I worked with Alicia while she was assigned as a Special Agent and Senior Special Agent in the Central Intake Unit with the Office of Internal Affairs. Her job within the Central Intake Unit was to analyze cases for potential violations of policy and make recommendations to the Central Intake Panel, which is a review board making dispositional determinations about the cases.

In her role as a Special Agent, Alicia was required to review statements made by inmates, witnesses, subjects and complainants to determine if violations of policy had occurred. Additionally, Alicia would have to review any other additional evidence, such as police reports, surveillance footage, Local Operational Policies, and Memoranda of Understanding to make these determinations. Alicia was extremely meticulous in her approach to the case work. She was also required to demonstrate her skills of objectivity to arrive at a fair and impartial conclusion. During this time, I was required to review her work along with a Department Attorney and a court mandated monitor (Office of the Inspector General). Alicia's work stood up to extreme scrutiny and did not require any additional oversight, which can be necessary for other Special Agents in the same position.

During her time in the Central Intake Unit, Alicia also demonstrated her flexibility, self-motivation and team oriented attitude. Alicia showed her value by taking the specialized cases, such as Equal Employment Opportunity cases, which required far more work than the non-specialized cases. Alicia was able to use her unique vision to understand that the unit's ability to complete cases within the mandated timeframes was in great peril if she did not step-up to take on the additional workloads. As the cases mounted, Alicia was also willing to take on inquiry work that was normally completed by other units. Her willingness to work as a team player was a tremendous asset to our program as we struggled to meet the obligations of our core mission.

Alicia also had a vital role in tracking and responding to complaints made against departmental staff at High Desert State Prison. Alicia's organizational skills helped the Department develop timelines and prioritization levels for the most serious complaints made against the prison. Alicia's professionalism under pressure and ability to complete the work within the required timeframes ensured a successful operation. Alicia's ability to work with members of the Prison Law Office, Office of the Inspector General and staff from CDCR were extremely helpful in generating the positive outcome.

I moved to my current position as the Chief of Field Operations in 2018. In my current role I am responsible for statewide Regional Investigations throughout the Office of Internal Affairs. Alicia is assigned as a Senior Special Agent within the Northern Region, which is a supervisory position for the Special Agent classification. She is responsible for reviewing cases and ensuring that each case goes to the Special Agent with the best skill-set to complete each investigation. She is required to use the resources of her team to ensure balanced caseloads and to monitor the progression of cases that are assigned to her team. Her position requires that she be able to effectively manage people to ensure continued successful operations. Alicia's excellent attention to detail ensures that the reports from her team are thorough and accurate. Alicia's high level of organization and adept delegation make her team one of the most productive investigative teams in the Northern Region.

While working with Alicia she has been tasked with numerous specialized responsibilities. She has been chosen for these tasks because of her excellent written and verbal skills. Her verbal presentations are very well organized and presented in a manner that is easy to understand despite the complex nature of the material. Her proficiency in communication has made her a primary choice for specialized responsibilities and a leader in her work area.

I am also a founding and current board member of River Charter Schools and active generally in local community and civic organizations. I have known Alicia Fernandez for 15 years since my family and I first moved to the community of Clarksburg, where Alicia was originally raised and she and her own family have now lived for the last 18 years. I have seen first-hand through our work together founding and sustaining two schools in our community how she performs in settings requiring teamwork, collaboration, compromise, and detailed attention to drive effective solutions. Alicia with a handful of engaged parents lead the effort to turn the tide, working effectively with the school district and state board of education to devise a plan that not only preserved the elementary school, but did it in a way that grew the community in unexpected ways through the charter school program. With Alicia's leadership and dedication, the solution grew from 180 student elementary school to now two schools with over 700 students, well on our way to reaching 1000 within the next few years. In our board, Alicia showed exceptional strength through her attention to detail. She put in extra time to really review the matters before us, becoming very intimate with the numbers at the base of our decision making, as well as the financial impacts and the community impacts that our decisions could have. Ms. Fernandez's professional resume includes many years of working for the State of California in the Department of Corrections and Rehabilitation in the office of Internal Affairs as a Senior Special Agent. For five years she worked for the California Department of Education as a Fiscal Services Consultant. All of these positions she has held which amount to over 30 years would serve her well if she was selected to be a member of the 2020 Citizens Redistricting Commission.
Mrs. Fernandez's educational credentials include a Bachelor of Science and Master's Degree in Business Administration. This is noteworthy because she and her siblings were the first generation of the family to attend college. Being raised in a home where Spanish was the primary language was a great example of Alicia's determination to attain her goal of a college degree.
Alicia has served her hometown community in a variety of volunteer activities She is a current member of the River Delta Unified School District having served for the last 12 years. During the very fiscally difficult years in education during the 2009-2010 the River Delta school board had to trim almost 20% of the total budget. There were cuts that Alicia and I did not agree on but she always was respectful and willing to accept what the other board members voted on for the program cuts. Other community organizations she has volunteered for include coaching at the local schools, as well as being very active in her church.
Finally, I would offer that Alicia is the kind of citizen that the Redistricting Commission should be adding to their team. She would work diligently to ensure that fair district lines are drawn throughout California that will be fair representation of all California citizens.
